Core Commitment

This Privacy Policy sets out how LionRT Inc. and its affiliated companies ("LionRT", "we", "our" or "us") collect, use, disclose, process and protect any information that you give us when you use our products and services located at lionrt.com, admin.lionrt.com, broker.lionrt.com, and our software applications that we offer for mobile devices. Should we ask you to provide certain information by which you can be identified when using LionRT products and services, it will only be used in accordance with this Privacy Policy and/or our terms and conditions for users.

The Privacy Policy is designed with you in mind, and it is important that you have a comprehensive understanding of our personal information collection and usage practices, as well as full confidence that ultimately, you have control of any personal information provided to LionRT.

In this Privacy Policy, "personal information" means information that can be used to identify an individual, either from that information alone or from that information combined with other information LionRT has access about that individual. Such personal information may include your name, address, telephone number and email address.

By using LionRT products and services, you are deemed to have read, acknowledged and accepted all the provisions stated here in the Privacy Policy, including any changes we may make from time to time. We are committed to protecting the privacy, confidentiality and security of your personal information by complying with applicable laws, including your local data protection legislation. We are equally committed to ensuring that all our employees and agents uphold these obligations.

What information is collected and how do we use it?

Types of Information Collected

In order to provide our services to you, we will ask you to provide personal information that is necessary to provide those services to you. If you do not provide your personal information, we may not be able to provide you with our products or services.

We may collect the following types of information (which may or may not be personal information):

  • Information you provide to us or upload(including your contact details): we may collect any and all personal information you provide to us, like your name, mobile phone number, email address, delivery address, order, invoicing details, data, messages, feedback, and any other information you provide to us.
  • Location information(only for specific services/functionalities): various types of information on your location. For example, country code, city code, mobile network code, cell identity, longitude and latitude information, language settings.
  • Log information: information related to your use of certain functions, apps and websites. For example, cookies and other anonymous identifier technologies, IP addresses, temporary message history, standard system logs.
  • Other information: environmental characteristics value (ECV) (i.e. value generated from device ID, connected Wi-Fi ID and location value).
  • We will never store extraneous sensitive information including WiFi password within our remote servers or databases.

How the personal information is used

Personal information is collected for providing services and/or products to you, and legal compliance on our part under applicable laws. You hereby consent that we may process and disclose personal information to our affiliated companies (which are in the communications, social media, technology and cloud businesses), Third Party Service Providers (defined below) for the purposes stated in this Privacy Policy.

We may use your personal information for the following purposes:

  • Providing, processing, maintaining, improving and developing our goods and/or services to you, including after-sales and customer support and for services on your device or through our websites.
  • Communicating with you about your device, service or any general queries, such as updates, customer inquiry support, information about our events, notices.
  • Conducting marketing related activities, such as providing marketing and promotional materials and updates. For more information on marketing and promotional activities, please refer to the Direct Marketing section below.
  • Allowing you to post content in public areas.
  • Conducting promotional activities, such as sweepstakes.
  • Analysing and developing statistical information on use of our products and services to better improve our products and services.
  • Storing and maintaining information about you for our business operations or legal obligations.

Here are more details on how we use your information (which may include personal information) -

  • Setting up your LionRT Account. Personal information collected when creating a LionRT Account on our web sites or through our devices is used for creating the personal LionRT Account and profile page for the user.
  • Setting up your Enterprise Account. Information collected when creating a LionRT Enterprise Account on our web sites is used for creating the Administrative LionRT Account for the client. Further information regarding devices, and teams, are also collected for using our services.
  • Processing your purchase orders. Information relating to e-commerce orders may be used for processing the purchase order and related after-sales services, including customer support and re-delivery. In addition, the order number is used to cross check the order with the delivery partner as well as the actual delivery of the parcel. The receipt details, including name, address, phone number and postal code are for delivery purposes. The email address is used to send parcel tracking information to the user. The list of purchased item(s) is used for printing the invoice and allowing users to see what is in the parcel. This process may be handled by us or our Amazon® affiliate.
  • User experience. Some opt-in features, such as the Notifications Subscriptions, allow LionRT to perform it's notifications functionality when providing details of the destination.
  • Sending notices. From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies.
  • Conducting promotional activities. If you enter into a sweepstake, contest, or similar promotion, e.g. via LionRT’s Facebook page or other social media platforms, we may use the personal information you provide to administer those programs.

Direct Marketing

  • We may use your name and email address, and previous purchases to provide marketing materials to you relating to goods and services of LionRT and affiliates to offer network, mobile applications and cloud products and services. If you no longer wish to receive certain types of email communications you may opt-out by following the unsubscribe link located at the bottom of each communication. We will not transfer your personal data to our business partners for use by our business partners in direct marketing.

Analytics and Other Technologies (only when browsing lionrt.com)

  • What information is collected and how do we use them?Technologies are used by LionRT and our Third Party Service Providers to observe trends relative to administering the site. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.
  • Log Files: As true of most websites, we gather certain information and store it in log files. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We do not link this automatically collected data to other information we gather about you.
  • Advertising: We partner with our Third Party Service Providers to either display advertising on our website or to manage our advertising on other sites. Our Third Party Service Provider may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you advertising based upon your browsing activities and interests..
  • Local Storage and Cookies: We use Local Storage Mechanisms (LSMs) to run portions of our services. Various browsers may offer their own management tool for removing LSMs.

Who do we share your information with?

We do not sell any personal information to third parties.

We may disclose your personal information on occasion to third parties (as described below) in order to provide the products or services that you have requested.

Disclosure may be made to Third Party Service Providers and affiliated companies listed in this section below. In each case described in this section, you can be assured that LionRT will only share your personal information in accordance with your consent. You should know that when LionRT shares your personal information with a Third Party Service Provider under any circumstance described in this section, LionRT will contractually specify that the third party is subject to practices and obligations to comply with applicable local data protection laws. LionRT will contractually ensure compliance by any Third Party Service Providers with the privacy standards that apply to them in your local jurisdiction.

Sharing with our Group and Third Party Service Providers

From time to time, in order to conduct business operations smoothly in providing you with the full capabilities of our products and services, we may disclose your personal information from time to time to other LionRT affiliated companies (in communications, social media, technology or cloud businesses), or our third party service providers which are our mailing houses, delivery service providers, telecommunications companies, data centres, data storage facilities, customer service providers, advertising and marketing service providers. Such Third Party Service Providers would be processing your personal information on LionRT’s behalf or for one or more of the purposes listed above. We may share your IP address with third parties when using certain mobile applications on our device in order to provide you with some of the services you requested.

Sharing with our Group’s ecosystem companies

LionRT works together with a group of companies, which together form the LionRT Ecosystem. The LionRT Ecosystem companies are independent entities, and highly qualified in their respective fields. LionRT may utilize your data within the LionRT Ecosystem companies so as to provide you with and improve the exciting products and services. The LionRT Ecosystem companies may also share data with LionRT from time to time in relation to products and services to provide hardware and software services, and to create better features and user experience for our clients. If LionRT is involved in a merger, acquisition or asset sale of all or a portion of our assets, you will be notified via email and/or a prominent notice on our website, of any changes in ownership, uses of your personal information, and choices you may have regarding your personal information.

Sharing with Others

LionRT may disclose your personal information without further consent when required under applicable law.

Information Not Requiring Consent

  • We may share anonymised information and statistics in aggregate form with third parties for business purposes, for example with advertisers on our website, we may share them trends about the general use of our services, such as the number of customers in certain demographic groups who purchased certain products or who carried out certain transactions.

Security Safeguards

LionRT’s Security Measures

We are committed to ensuring that your personal information is secure. In order to prevent unauthorised access, disclosure or other similar risks, we have put in place reasonable physical, electronic and managerial procedures to safeguard and secure the information we collect on your devices and on LionRT websites. We will use all reasonable efforts to safeguard your personal information.

When you send or receive data from your LionRT devices, we make sure the data are encrypted using Secure Sockets Layer and other encryption algorithms.

All your personal information is stored on secure servers that are protected in controlled facilities. We classify your data based on importance and sensitivity, and ensure that your personal information has the highest security level. We make sure that our employees and Third Party Service Providers who access the information to help provide you with our products and services are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet such obligations. We have special access controls for cloud based data storage as well.

Personal Liability

  • You agree to safeguard personal information by not disclosing your login password or account information to anybody unless such person is duly authorised by you, and as outlined in theUser Agreement. Whenever you log on LionRT websites, particularly on somebody else's computer or on public Internet terminals, you should always log out at the end of your session.

  • LionRT cannot be held responsible for lapses in security caused by third party accesses to your personal information as a result of your failure to keep your personal information private. Notwithstanding the foregoing, you must notify us immediately if there is any unauthorised use of your account by any other Internet user or any other breach of security.

  • Your assistance will help us protect the privacy of your personal information.

Retention Policy

Personal information will be held for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws. We shall cease to retain personal information, or remove the means by which the personal information can be associated with particular individuals, as soon as it is reasonable to assume that the purpose for which that personal information was collected is no longer being served by retention of the personal information.

Accessing other Features on your Device

Our applications may need access to certain features on your device such as enabling emails, phone notifications and Wi-Fi network connection status, as well as other features. This information is used to allow the applications to run on your device and allow you to interact with the applications. At any time you may revoke your permissions by turning these off at the device level or contacting us atinfo@lionrt.com.

User Control of Privacy

Controlling settings

LionRT recognises that privacy concerns differ from person to person. Therefore, we provide examples of ways LionRT makes available for you to choose to restrict the collection, use, disclosure or processing of your personal information and control your privacy settings:

  • Toggle on/off data transfer at the device level;
  • Assigning permissions at the administrative level in our Enterprise interface;
  • Deleting information stored on LionRT Cloud by contacting us directly atinfo@lionrt.com; and
  • Changing your password and/or email information.

Access, Updating or Correcting Your Personal Information

  • You have the right to request access to and/or correction of any other personal information that we hold about you. When you update your personal information, you will be asked to verify your identity before we proceed with your request. Once we obtain sufficient information to accommodate your request for access to or correction of your personal information, we shall proceed to respond to your request within any timeframe set out under your applicable data protection laws.
  • We normally provide such services for free but reserve the right to charge a reasonable fee for your data access request.
  • If you would like to request access to your personal data held by us or if you believe any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible at the email address below. Email:info@lionrt.com.
  • You may withdraw your consent for the collection, use and/or disclosure of your personal information in our possession or control by submitting a request. This may be done by contacting us atinfo@lionrt.com. We will process your request within a reasonable time from when the request was made, and thereafter not collect, use and/or disclose your personal information as per your request.
  • Please recognise that your withdrawal of consent could result in certain legal consequences. Depending on the extent of your withdrawal of consent for us to process your personal information, it may mean that you will not be able to enjoy LionRT’s products and services.

Transfer of personal information outside of your jurisdiction

To the extent that we may need to transfer personal information outside of your jurisdiction, whether to our affiliated companies (which are in the communications, social media, technology and cloud businesses) or Third Party Service Providers, we shall do so in accordance with the applicable laws. In particular, we will ensure that all transfers will be in accordance with requirements under your applicable local data protection laws by putting in place appropriate safeguards.

LionRT may use overseas facilities operated and controlled by LionRT to process or back up your personal information. Currently, LionRT has data centres in New York, San Francisco and Charlotte. These jurisdictions may or may not have in place data protection laws which are substantially similar to that in your home jurisdiction. We may transfer to and store your personal information at our overseas facilities. However, this does not change any of our commitments to safeguard your personal information in accordance with this Privacy Policy.

Miscellaneous

Minors

  • We consider it the responsibility of parents to monitor their children’s use of our products and services. Nevertheless, it is our policy not to require personal information from minors or offer to send any promotional materials to persons in that category.
  • LionRT does not seek or intend to seek to receive any personal information from minors. Should a parent or guardian have reasons to believe that a minor has provided LionRT with personal information without their prior consent, please contact us to ensure that the personal information is removed and the minor unsubscribes from any of the applicable LionRT services.

Order of Precedence

If you have agreed to our applicable User Agreements, in the event of inconsistency between such User Agreements and this Privacy Policy, such User Agreements shall prevail.

Updates To The Privacy Policy

We keep our Privacy Policy under regular review and may update this privacy policy to reflect changes to our information practices. If we make material changes to our Privacy Policy, we will notify you by email (sent to the e-mail address specified in your account) or post the changes on all the LionRT websites or through our mobile devices, so that you may be aware of the information we collect and how we use it. Such changes to our Privacy Policy shall apply from the effective date as set out in the notice or on the website. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of products and services on the websites, mobile phones and/or any other device will be taken as acceptance of the updated Privacy Policy. We will seek your fresh consent before we collect more personal information from you or when we wish to use or disclose your personal information for new purposes.

Do I have to agree to any third party terms and conditions?

Our Privacy Policy does not apply to products and services offered by a third party. LionRT products and services may include third parties’ products, services and links to third parties’ websites. When you use such products or services, they may collect your information also. For this reason, we strongly suggest that you read the third party’s privacy policy as you have taken time to read ours. We are not responsible for and cannot control how third parties use personal information which they collect from you. Our Privacy Policy does not apply to other sites linked from our services.

Here are third party terms and privacy policies that apply when you use these specific products:

  • By using Stripe or other third party check-out services to finalize and pay for your order, you are agreeing to the third party check-out service provider’s privacy policy will apply to the information you provide on their website.
  • By using our services, you are agreeing to Red Hat, Google Analytics, and Amazon Web Services Terms of Services

Social Media (Features) and Widgets

Our websites include social media features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social media features and Widgets are either hosted by a third party or hosted directly on our websites. Your interactions with these Features are governed by the privacy policy of those companies providing their service.

DATA POLICY

This Data Policy (the “Policy”) describes LionRT’s policy for handling, storing, and otherwise treating certain types of data of LionRT’s customers (each, a “Customer”), including data associated with individual users and employees of Customer organizations, in each case pursuant to a Customer Agreement (as defined below). “LionRT” means LionRT, Inc. and its subsidiaries and affiliates.

Additional policies that apply to specific LionRT Products and Services can be found at the end of this Policy, in the section entitled “Service-Specific Terms.”

OVERVIEW

LionRT collects information that a Customer or other data sources send to LionRT as part of such Customer’s use of LionRT Products and Services. This data is addressed in three categories, “Transaction Data”, “Account Data” and “Personal Data”, each as defined below.

TRANSACTION DATA AND ACCOUNT DATA

Security

LionRT understands the sensitive nature of the data that Customer or Customer’s organization may provide while using LionRT Products and Services. LionRT will maintain commercially reasonable administrative, physical and technical safeguards designed for the protection, confidentiality and integrity of Customer’s Transaction Data and Account Data.

Data Use by LionRT

Access. LionRT places strict controls over its employees’ access to Customer’s Transaction Data and Account Data that resides in the LionRT Products and Services, and is committed to ensuring that Customer’s Transaction Data and Account Data is not used by anyone who should not have access to it. The operation of the LionRT Products and Services requires that some employees have access to Customer systems which store and process Customer’s Transaction Data and Account Data. For example, in order to diagnose a problem Customer is having with LionRT Products and Services, the LionRT support team may need to access Customer’s Transaction Data. These employees are prohibited from using these permissions to view Customer’s Transaction Data unless it is necessary to do so.

Ownership. As between LionRT and Customer, Customer or its licensors own all right, title, and interest in and to the Transaction Data and Account Data. LionRT obtains no ownership rights under this Agreement from Customer or its licensors to any Transaction Data or Account Data.

Use of Transaction Data. LionRT will treat Transaction Data as confidential and will use it only to: (i) facilitate operation of the LionRT Products and Services; (ii) enhance the use of the LionRT Products and Services and its related web pages; (iii) perform internal tracking to improve LionRT Products and Services; (iv) analyze the extent to which Customers use LionRT Products and Services; (v) enable LionRT to contact its Customers; (vi) process, bill and invoice Customer’s transactions for LionRT Products and Services usage; (vii) make backups in order to prevent data loss; and (viii) comply with the law or a binding order of a governmental body. This permission includes allowing us to use third-party service providers in the operation and administration of LionRT Products and Services and the rights granted to us are extended to these third parties to the degree necessary in order for LionRT Products and Services to be provided. The Privacy Policy does not apply to Transaction Data.

Use of Account Data. LionRT will only use Account Data in accordance with the Privacy Policy, and Customer consents to such usage.

Feedback.If any Customer users provide LionRT with any feedback, support tickets, reported defects, usability enhancements, feature requests or suggestions regarding LionRT Products and Services, Customer grants LionRT an unlimited, irrevocable, perpetual, free license to use any such feedback or suggestions for any purpose without any obligation to Customer.

Retention of Transaction Data and Account Data

Data collected by LionRT as part of diagnostic bundles will be retained for a period of 12 months. All other Transaction Data and Account Data may be retained no longer than as permitted by governing law, but in no event longer than for the life of the related LionRT product + 10 years.

Incident Management and Response

In the event of a security breach involving LionRT Products and Services, LionRT will promptly notify each affected Customer of any unauthorized access to any of such Customer’s Transaction Data or Account Data that was stored in LionRT Products and Services. LionRT has internal incident management procedures in place to handle such an event.

Product Security Practices

New features, functionality, and design changes go through a security review process facilitated by LionRT’s security team. The security team works closely with development teams to resolve any additional security concerns that may arise during development.

PERSONAL DATA

LionRT’s current Privacy Policy is incorporated into this document and includes important terms regarding LionRT’s handling of Personal Data. The sections above relating to Incident Management and Response and Product Security Practices also apply to Personal Data.

CUSTOMER RESPONSIBILITIES

Customer Account and Account Data

To access certain LionRT Online Services, Customer may be asked to create a LionRT account associated with a valid e-mail address (a “Customer Account”). Customer may only create one account per email address. Customer is responsible for: (i) maintaining the confidentiality of the Account Data, (ii) monitoring and controlling which end users have access to the Customer Account; and (iii) all activities that occur under the Customer Account, regardless of whether the activities are undertaken by Customer, Customer’s employees or a third party (including Customer’s contractors or agents). Except to the extent caused by LionRT’s breach of this Data Policy, LionRT and its Affiliates are not responsible for unauthorized access to the Customer Account. Customer will contact LionRT immediately if Customer believes an unauthorized third party may be using the Customer Account or if Customer’s Account Information is lost or stolen.

Acceptable Use

Customer must not: (i) use, or encourage, promote, facilitate or instruct others to use, LionRT Products and Services for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, or offensive; (ii) use LionRT Products and Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device; (iii) make network connections to any users, hosts, or networks unless Customer has permission to communicate with them; (iv) use LionRT Products and Services to transmit spam, bulk or unsolicited communications; or (v) use LionRT Products and Services to collect and store personally identifiable information about any person unless specifically authorized by such person.

Transaction Data, Account Data and Personal Data

Customer is solely responsible for the creation, operation and maintenance of Transaction Data, Account Data and Personal Data. For example, Customer is solely responsible for:

  • the technical operation of LionRT Products and Services, including ensuring that calls Customer makes to any LionRT Online Service are compatible with then-current APIs for that LionRT Online Service;
  • compliance with the Acceptable Use provisions herein;
  • compliance with all applicable laws;
  • any claims relating to Transaction Data, Account Data and Personal Data;
  • anonymizing data to the extent Customer deems it reasonable or prudent to do so; and
  • properly handling and processing notices sent to Customer (or any of its affiliates) by any person claiming Customer’s data violates such person’s rights, including notices pursuant to the Digital Millennium Copyright Act.

Customer agrees that its Transactional Data, Account Data and Personal Data will not include information regulated under the International Traffic in Arms Regulations (U.S. government regulations addressing defense-related articles and services).

Customer agrees not to upload, post or otherwise transmit to LionRT any Transaction Data that: (a) is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable; (b) includes unauthorized disclosure of personally identifiable information or other confidential information; (c) violates or infringes any third party intellectual property rights; or (d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. LionRT reserves the right to edit or remove Transaction Data that violates this Policy.

By providing Transaction Data, Customer represents and warrants to LionRT that Customer owns or otherwise possesses all intellectual property rights and other rights necessary to provide such Transaction Data and to permit others to make use of such Transaction Data.

Security and Backup

Customer is responsible for taking its own steps to maintain appropriate security, protection and backup of Transactional Data, Account Data and Personal Data, which may include the use of encryption technology or anonymization to protect such data from unauthorized access.

Customer Data

LionRT Products and Services do not store or process any Customer Data. Customer Data is either located on a third-party hosting site or on Customer’s own servers and it does not reside in the LionRT Products and Services. As such, LionRT has no liabilities or obligations with respect to Customer Data under this Data Policy.

DEFINITIONS

Account Data” means information about Customer that Customer provides to LionRT in connection with the creation or administration of its LionRT account. For example, Account Data includes names, user names, phone numbers, email addresses and billing information associated with Customer’s LionRT account.

"LionRT Products and Services"means any of LionRT’s products and software to which Customer may have subscribed under the terms of a Customer Agreement, including but not limited to LionRT Manager, LionRT Enterprise, LionRT Live, LionRT Express, LionRT Director, any LionRT Online Services, any trial software, and any software related to the foregoing.

Customer Agreement” means the separate agreement between Customer and LionRT governing Customer’s use of the LionRT Products and Services.

Customer Data” means any of Customer’s originating data that might be stored in nodes and accessed by LionRT’s software or other third-party software.

Personal Data” means data that can identify an individual or that is associated with the identity of an individual.

Privacy Policy” means the privacy policy currently referenced at http://www.lionrt.com/legal/policies.html#privacy, as it may be updated by LionRT from time to time.

Transaction Data” means all data that is (i) input into LionRT Products and Services by Customer or its end users, (ii) generated by LionRT’s systems as a result of Customer’s or its end users’ use of the LionRT Products and Services, or (iii) data that is generated for troubleshooting and diagnostics, in each case that is transmitted to LionRT. Transaction Data does not include Customer Data.

In the event of a conflict between this Policy and the terms of the applicable Customer Agreement, the terms and conditions of this Policy apply, but only to the extent of such conflict.

SERVICE-SPECIFIC TERMS

LionRT Navigator Optimizer

Data Use. LionRT’s Navigator Optimizer service (“Optimizer”) does not collect or store any Personal Data or Customer Data. Optimizer may collect and/or store certain types of Transaction Data such as Customer’s queries or workload information (“Optimizer Data”). While Optimizer Data is confidential information and will be protected pursuant to the provisions in this policy that apply to Transaction Data, Optimizer is not a database of record for the storage of Optimizer Data. Retention of this Optimizer Data is not LionRT’s responsibility.

Availability. LionRT is committed to making Optimizer a highly-available service that Customers can count on. To the extent feasible, LionRT’s infrastructure runs on systems that are fault-tolerant, for failures of individual servers.
